Georgia Child Custody Lawyer

Regardless what kind of spouse your ex was, he or she might be a decent or even good parent. Absent extraordinary circumstances, that person will continue to have the legal right to significant time with your child. This is because society and the courts now believe that children benefit most from strong bonds with both parents. Courts protect the vulnerable, among other things, and "the best interest of the child" is a very high legal priority today.

If you have been divorced, and an order of custody is in effect, you may now need it to be modified. If you are now getting divorced, there are several possibilities for the custody arrangement.

"Legal custody" refers to your and your ex's legal right to make important decisions regarding your child and his or her upbringing. You will probably both have input into decisions regarding schooling and religious upbringing, for example.

"Physical custody" refers to where they the child stays/sleeps. This is not as straightforward as it once was. Most often, spouses will continue to reside close enough that the child(ren) can conveniently spend time with both. One person may have sole custody while the other has visitation. In partial or shared custody arrangements the child has a bedroom, clothes and toys in both homes.

Modification

If your circumstances have changed, contact our firm to learn more about your options. If work, or another factor areis motivating you to move farther away from your ex spouse, a modification of the child custody order will be necessary.
